Second concussion-related lawsuit filed against NHL

Listed among the allegations in the second concussion-related lawsuit (PDF) to be filed against the NHL:

— “The NHL Fosters a Culture of ‘Enforcers’ and ‘Goons'”

— “The NHL Uses Its Extreme Violence as a Commodity to Generate Billions of Dollars”

— “Despite Knowledge of the Imminent Risk of Head Trauma and Its Devastating and Long-Term Negative Health Effects, the NHL Has Failed to Warn and Adequately Protect Its Players”

Plaintiffs include former NHLers Dan LaCouture, Dan Keczmer, and Mike Peluso.

The suit maintains that each plaintiff “was, has been and will continue to be damaged as a result of the NHL’s misconduct.”

It also maintains that LaCouture, who played over 300 games in the NHL, “suffers from headaches, irritability, sensitivity to light, change of personality, and depression.”

Damaging its credibility, however, is the suit’s assertion that NHL legend Gordie Howe died in 2009 from a neurodegenerative disease called Pick’s disease. In fact, Howe is still alive. It was his wife, Colleen, who died of the disease.

The suit also identifies Sidney Crosby as “Sydney Crosby.”

The NHL was hit with its first concussion-related lawsuit in November.

      time to get a new lawyer. i guess those players could say it was the head trauma that caused them to choose shiite lawyers in the first place. it’s an example of the damage their brains have suffered.

    Seems like some pretty knowledgable lawyers. They only misspelled the biggest name in the league and pronounced Mr Hockey dead. I see no way they can lose this case.

    Seems like it’s on the same level of mentality as the rest of the people who use Sydney/Cindy/Crysby.

    Actually I don’t think I’ve ever seen anybody use the feminine spelling of the name – beyond them I guess.

    Misspellings and errors were caused by the effects of concussions from playing hockey.

    Throw this out! Fail, at every aspect!

      All caps is typical for the title of proceedings and headings in legal documents. Typos are also common, but inexcusable when you consider that every word processing program has a spell-check option.

    Does anyone else find it ironic that Jack Carlson is one of those filing the suit? Talk about extreme violence as a commodity.

    in most courts the misspelling of names or supplying faulty information or any other error in process are those elements in wouldb-be lawsuits simply corrected as proceedings advance

    both sides deal with the same issues in every lawsuit filed … i’ve always wondered if these mistakes are not part of legal processes subtly employed in unwritten code by opposing lawyers in effort to inflate fees

    for every winning lawyer there’s a losing lawyer … best set up a process where both sides can cover costs associated with running a law practice, wot …

    if anyone thinks lawyers care about public image they live in a dream world … lawyers themselves admire ability to be clever and devious but most of all, they admire ability to leech fees from suckers

    i’ve been at parties involving lawyers and when the drink flows and talk runs high, you hear them bragging-up their fees and you hear them working out ways to press for fees in cases within which they sit on opposing sides

    that isn’t to say all lawyers are corrupt … not true at all … some of the finest minds and most honourable people in the world are lawyers … i’ve been involved with labour lawyers over the years and there are some among those that are worthy of sainthood

    then you have the whores pursuing estate law or family law … estate law and divorce law draws the worst of the vampires … law sanctioned robbery

    if defence lawyers in any suit object to elements in a filing the elements are simply corrected or refiled … there are ample formal notice and application processes solely in place for the purpose

    hours are spent in chambers sorting this sort of thing out so when a lawsuit is certified, legal machinery can proceed smoothly in that part of legal proceedings that costs taxpayers money … specifically the cost of the judiciary and its elements in managing law itself

    cases are judged on arguments substantiated by proof as opposed to fact, not by spelling errors or by those wrongly-named … odds-on these lawyers are expert in class action law, but have never suffered an afternoon listening to pierre mcguire

    not when they’re forced to scratch out a living where every free minute is begrudged as billing time lost

    i wonder how a lawsuit like this would be won if there is a professional sports (entertainment) business that literally is violence. UFC, MMA whatever that stuff is…its literally using extreme violence to generate a lot of money in revenue.

    foster a culture of goons and enforcers, im not sure there is any legal base to that.

    if you can prove they were negligent thats they only merit this case would have. im in no position to judge that.

    just seems like this is more of a fishing expedition than anything, especially when you use examples like the Howe situation, which is incredibly insensitve and almost disturbing. you filed papers with a court using his death as something to support your case and hes not dead, its his wife. and what does crosby have to do with it? hes healthy, and was never intentionally put into harms way while injured.
