The counter suit (anti-trust lawsuit) would have the players named in the current NHL lawsuit as the plaintiffs, this group would basically be doing the work for every player since the settlement of said case would likely be a new CBA (see Reggie White v the NFL) it would also open the door for other players to individually file suit against the NHL.

Also note the NHLPA itself wouldn’t completely dissolve it would just go from a union to a trade association, and Donald Fehr would go from head of the union to outside legal council, he would still advise the players but could only negotiate on the players behalf if the NHL signed a waiver saying so.

I still don’t understand how that would go down. If the players union gets ‘dissolved’ how can they join together and sue the NHL as one entity? Wouldn’t they just be 700 individual people and not one huge union? Class action?

Its funny you brought up an “IP Ban”… I got banned by NHL.com way back in Sept or so.. not for being a troll or anything but they had an article about “Records that will never be broken…” or something along those lines and I posted.. “Hey, you guys missed one ’3 Lockouts under the same leadership!’” and the anal retentive moderators banned me because I got like 800 likes or something like that. I mean realistically once it got to like 200 people were just telling people in other articles to go click like on it trying to get it passed say 400 then 500 etc etc.. but still.. Yup that’s what got me an IP Ban!

Legal analyst Rob Becker was just on Sportsnet and said that the window for the players approval of a disclaimer of interest expired HOWEVER the union brass (Donald Fehr) can disclaim interest on his own at anytime. The union is due in court on Monday to file their response to the league’s lawsuit, Becker speculated that if things go off the rails in the meantime Fehr will disclaim interest and the PA’s response would include a counter suit against the league which would be an anti-trust lawsuit….hopefully it doesn’t get to that point!
