I heard an interview about this a couple of weeks ago and here's the issue: he was traded a few years ago from Edmonton to Anaheim (I believe) before his original no trade clause kicked in, when a player goes to a new team his no trade clause does not go with him, instead it's up to the new team to agree to it and allow they player to have it, so in this case he likely never had a no trade clause when he thought that he did.

He had a NTC when he signed his contract with the Oilers. He waived it to go to the Ducks. Now it gets into all the legal laugague if that NTC is still valid. Some contract like Jeff Cater/Mike Richards last off season lost their NTC/NMC once they were traded. They didn't wave their rights. Cater lost his right to have his NMC/NTC before he ever had it. He signed his extension and got traded before it kicked in. This is the NHLPA trying to better serve its members and strengthen itself.

wouldnt you think that this would have come up earlier IF the trade violated the ntc... as a player/employee wouldn't you want to know your employment agreement in and out, what about the gm's responsibility of knowing what he is trading and the confinements of the player's contract? idk, seems fishy to me that it came up a MONTH later, and it seems like hes trying to find an out from playing for the islanders much like nabakov.

but again thats on the assumption that it doesn't violate the contract...

IF the trade violates his contract he has every right to do what he is doing. Why should he suck it up and play if a right he was given in his contract is not followed? Most likely nothing will come for this but I would imagine the NHLPA is just using this as a way to try and close the "loophole" in the contract language that allows some players NMC/NTC to go away after they are not with the team they signed the deal with.
